In the state of Colorado does the engagement ring need to be returned if the marriage does not take place.

The general rule is that if the person who received the ring was the person who broke the engagement, then the ring is to be returned. If the person who received the ring is not the one who broke the engagement, the ring does not have to be returned.
It is always wise to consult at attorney about your specific situation to be sure there are not other considerations in your case.
