My daughters father and I moved to Denver together 6 years ago, he moved back to Grand Junction about a year ago. We have never gone to court, and now the time for my daughter to go to school has come. We cannot make a civil decision where she should go. What is the pobability I would get her if we went to court. I have a job, he doesn't. He as an extensive crimial record, I dont. He lives with his girlfriend who has a job. I have a reliable day care. I also live in the best school district in CO.

You definitely should file a Petition for Allocation of Parental Responsibilities. This will protect both of you, and your daughter, as it will get a parenting schedule in place. You will still be able to work together to modify it as it makes sense.
As for your odds, there are several key facts the Court must consider which you did not mention. Since the two of you split, where has your daughter spent most of her time? Do either of you have extended family near where you presently live? Is your daughter involved in any community activities or clubs? These are other things the Court must consider. The factors you mentioned are a good start toward you being likely to win the primary parenting time. Also, be aware that the Court will require you to try mediating this issue.
