does the father have custody rights?

I have been dating a woman who has 2 children (ages 2 and 1) for a year. Their father does not support the children. When I first started dating this woman the father wouldn't even admit that the children were his. There was never a statement of paternity signed by either party. Now that I am in the mother's life the father now wants to be daddy but he still does not support the children financially. I currently am a guardian of the children and have been since November of 1999. Recently I lost my job and have been offered a position with a company in another state and we plan on moving. What rights does the father have to the children and can we just up and leave even if it is in the best interest of the children to do so? Any help would be greatly appreciated.

It sounds like the mother has sole custody. If so, she can move. Even if it's joint custody, the burden is on him to try and stop her.
