Legal Question in Family Law in Colorado

Fiancee trying to get away from ex boyfriend, child legal issue

I used to be engaged to a girl who might have had either my child or the child of the man she left me for. The baby is 6 months old and the other male is on the birth certificate. The problem is that her and I got back together and are awaiting a Paternity test to find out the father. She still resides with the other guy and is trying to get out but he refuses to let her leave with the threat of leaving with the baby. Is there a way for her to get out of the house and protect the child without her running away with the baby and getting in legal trouble herself?

The answer would depend upon which state she is living. In california she could move to a women's shelter, and file a petition to determine paternity. She would of course take the child with her. A restraining order could be obtained to keep him away from her and the child.

The procedure in Colorado may be much different.
