Legal Question in Family Law in Colorado

It is over with my girlfriend but I am afraid to tell her because I am afraid she will leave the state with my kids. Is there something I can file or do before I tell her so that she can not take my kids away?

You need to file a petition for allocation of parental responsibilities (through which the court will determine parenting time, decision making and child support). Once that is filed and served on her, an automatic temporary injunction goes into place barring either party from leaving the state with the children without the consent of the other party or a court order.

Keep in mind, until there is a court order about parenting time, both parties have an equal right to time with the kids. Feel free to call me if you would like to discuss this process further. Hope this helps.
