Legal Question in Family Law in Colorado

My husband was arrested in June 2008 for the murder of our 6month old son. i haven't been able to get an divorce but can i consider myself legally separated from him.

Why can't you get a divorce? As for being separated, you are not "legally" separated until and unless there is a court order.
