Husband lost his job and is now refusing to pay child support

My friend's ex-husband got fired from his job and is now telling my friend (2 kids) that he cannot pay child support. He is living with a woman and helping her out in her business (under the table). If the non-custodial parent loses employment, they is he still liable to pay the child support? Can my friend file for contempt of court even though her ex-husband does not have a job?

A person obligated to pay child support does not escape that obligation by being unemployed. Your friend's ex-husband must continue to pay the child support. However, you should know that without employment, the ex-husband may also seek to change the child support payment, and the revised payment will be dramatically lower than the previous amount. If the ex-husband continues to refuse to make payments, your friend should contact Colorado Child Support Enforcement, and they will advise her on how to proceed.
