Legal Question in Family Law in Colorado
My husband and his ex wife have shared custody of their two boys (50/50). She is deciding to become a stay at home mom. Can she come after us for more child support because she decided to stay home? How is it calculated now?

It depends on how old the boys are. Generally around the age of two and under the court will allow a parent to stay home and care for the children. After a certain age the court expects them to work. Many times one parent will not have a job and it can increase your husband's child support (it can't increase yours if you are not the parent). However, there are techniques that can be used to impute the working wage that she woud normally make or at the very least minimum wage. I would definitely get a lawyer to help you out with this process. It sounds like she may be coming after you soon. If you need our help. You can call the office and we can set an appt to talk about it in more detail. The number is 303-872-3249.
