Impending seperation and/or divorce
My son is 19- his wife of 9 months wants to be 'free'. She has been sleeping with another man. They have a 17mo old daughter. I am concerned for her welfare. They rent/are on food stamps and the wife has currently left the home with her daughter and is staying at a friends boyfriends house. WHERE DO WE START? What legal steps if any should my son be taking to insure he is in his daughters life and that she is okay? Can we get full or primary custody? Should we be helping him file for seperation? We do not know where to even start! She chose to move out- to her mothers house but is now having 'issues' with her mother so chose to stay at the apartment- my son has been driving up to our house to sleep to stay out of her way. after counseling with his pastor my son confronted his wife and told her that she needed to make some choices- if she wanted to stay in the apartment with him it needed to be as man and wife- or she needed to move out but that their daughter needed to stay- her welfare is in question and my son is really upset that she takes her daughter to the 'lovers' place with her. She refuses to speak to her pastor or any one else. Just wants to be left alone.

I am very sorry to hear your son is going through this awful situation.
He definitely needs to take action. He needs to file for either a legal separation or a divorce. In the course of that proceeding, it can be determined how much parenting time each parent will get. (Colorado doesn't use the term custody anymore, it's parenting time and decision making now.) He should do this sooner rather than later.
