leaving state

I plan to move to Colorado from Texas to be near family.

My husband says he is not going. If he sells our home dont I have to sign the papers also.

If he were to deside that he wanted a divorce could he use

the fact that I left him because of his health. Which is not the case at all.

We have been married almost 40 years.

What about what he has in 401. He has not worked in over ad year and is on disability because of his heart.

Your question is not as easy as I think you'd like.

If your name is on the mortgage and Deed then he should have to get your name on the documents. However, occasionally, a title company will slip up and forget to get the spouse to sign.

If you work, you might be looking at spousal support since your spouse is disbabled.

All community assets will be divided in the divorce, including the 401(k)
