Legal Question in Family Law in Colorado
Legal marriage or bigamy
We married in1960. He was married before,it ended in divorce. She was in Denver,he came to Ind. She sued for support in 57,case dropped in 58 because there was more evidence that he was not the father than was that he was. He was not to pay support. There is another notation in 61.He paid lawyer 150.00 for a divorce, was told that when support case was over divorce would be granted. He thought everything was done. They in Marion co.as we were. She told him that she was of age and signed marriage ap that she was 21. No one signed for her.She died in Sept.2000,it lists her as being born in '39.On the support suit it says she was 17.Is this not fraud? She remarried and he divorced her, that case began in 87 and was granted in 99 granted by conversion(whatever that means) WE must know for sure that we are legaly married and our children are legitimate.I find a case in the Southern District of Indiana, cause #IP98-0324-CH/G Harden vs.Edwards.Similar to ours. Common law marriage is not an option, due to our religion. Will take to court if needed. Must know that we are not living in sin. Are very much in love and did everything according to the law to marry(or thought that we had).

Common law marriage is a legal status, not religious. One can be common law married regardless of religion. On the other hand, if he cannot prove he was divorced, he may not have been married to you. On the third hand, if no other person raises the issue, it may not be important. You may be talking about a state of mind rather than the law.
