licence suspension

Isn't suspending a persons drivers licence a violation

of our Constitutional Rights? The XIV Amendment states

that ''No state shall make or enforce any law that shall

abridge the privilages and immunities of citizens of

the U. S. Nor shall any state deprive any person of

Life, Liberty, or Property.

in theory, any legal position is viably arguable in a court of law, and some often succeed. however, what dictates success is in various legal arguments is established by past case precedent. thus, you may want to research case precedents in respect to this specific area of law you are questioning. hope this helps.

It is my understanding that the court have taken the position that driving is a privilege and therefore this privilege can be abridged for good cause to protect the public.
