Legal Question in Family Law in Colorado
maintenance
Having been married for thirty-five years serving as a housewife, stay-at-home mon and assisting with husband's contracting and farming businesses, is he required to pay maintenance to me after our divorce, how is the amount calculated, and is education for my entering the workforce also included? I have derived a small amount of income from freelance art in the last few years but not nearly enough to maintain myself. All children are grown. Is the signed divorce settlement legal and binding as to responsable party on credit card debt and income tax debt? There is no real property involved and few assets.

Re: maintenance
Thank you for your inquiry. My name is Tawni Cummings and I am one of the family law attorneys at The Harris Law Firm.
There are a number of factors that the court will look at when deciding whether or not you will receive maintenance from your husband, and the potential amount and duration of any maintenance awarded. The factors include: whether you lack sufficient property to provide for your reasonable needs; whether you are able to support yourself through appropriate employment; the time necessary to acquire sufficient education or training to enable you to find appropriate employment; the standard of living established during the marriage; the ability of your husband to pay maintenance whild meeting his own needs, etc.
Unfortunately, however, without knowing more about your specific circumstances, I am unable to evaluate your situation and advise you what you may expect.
I would be happy to schedule a time to discuss your situation in greater detail. The fee is $150 for up to 45-minutes, and we can conduct the consultation by telephone, or in person here at the office.
