Legal Question in Family Law in Colorado

Never married with eleven year old would like to move out of State

My friend is moving with her daughter from Colorado to Michigan and the father has seen his daughter every other weekend off and on and has not paid child support nor ever been to court. He is not approving this move, what can my friend legally do? Can she move to be closer to her family and fiancee?

Re: Never married with eleven year old would like to move out of State

IF there has NEVER been any court order, she does not have to have his permission to move. She is legally permitted to move anywhere with the child.

HOWEVER, if there was EVER any court order issued, she needs to consult that order to see if it granted her permisison to move without first asking the court for permission. If there is such an order, but it does not specifically grant her permission to move out of state with the child, she needs to file a motion for permission to relocate with the child.

She should also keep in mind that at some point she should seriously consider getting a court order, as the father also has the same right to move anywhere with the child.
