Mother automatically have custody

Hello,

In the case that my wife and I get a divorce ''common law'', does she automatically get custody of our 2 and a half year old daughter?

No, she does not automatically get custody of the children. The Court will consider the circumstances of your situation in determining who gets what amount of parenting time. It will also consider the circumstances to determine who should get to make decisions for the children. Unless there is some reason not to, the Courts generally prefer to award joint decision making.
