move out of state with children

I filed for divorce june 2004. We have three children together. 10,6,and 4. Permanante orders are 4 weeks from now. In two weeks, we have a hearing with the judge regarding the house going into foreclosure. The children are living with me they see their father on the weekends. Last june,I got a perm. restr.order against my husband he has violated it three times in which he went to jail. He is pleading not guilty in all three cases. Nest wk i have to testify in the first case. His father has been an investgator with the sheriff's office for 27yrs. So he's just thinking he'll get a slap on the wrist again. Last july,the judge ordered him to pay the mortgage,my truck paymt,and 500.00 mo. in maintence. The house is now in foreclosure. My family had to make 8 out of 10 truck paymts and has only given me 1500.00 in maint. All of my family lives in upstate ny. i won't have anywhere to live when we lose the house will the judge say i can move to ny with the kids?

It is becoming more and more difficult to get an order from the court allowing a custodial parent to move from the state with the children. Most of the information in your email suggests you have a better case than most; however, recent cases in Colorado have set the bar higher and higher before a parent will be allowed to move with the children. Your email also indicates there are many financial issues you should have addressed at your permanent orders hearing. Generally, it appears your permanent orders hearing could be very complex.
