Legal Question in Family Law in Colorado

Parental Responsility

I have a couple questions

Is parental responsilbity the same as custody in Colorado?

In a juvenile guardianship case who needs to be notified?

If a father has never had his rights taken away, can someone else get guardianship

Re: Parental Responsility

That's quite an assortment of questions, all good ones.

First, yes, parental responsibility is the same as custody. They stopped using the word 'custody' here because it seemed too much like indicating that the child was a possession.

Second, in a guardianship case, typically both birth parents need to be notified. If there are other people who have had the child in their care for significant periods of time, they may be entitled to notice as well.

Third, yes it is possible to get guardianship without terminating parental rights. That is the big difference between guardianship and adoption.
