In December of 2005 I left my child in the care of a family friend (no blood relation), gave them legal gaurdianship, and moved out of state (ca). Since June of 2006 the papers have since expired and they have now filed a petition of custody on my son. I did ask them to return him to my care and they refused. I have a court date set to establish gaurdianship, which they persued. What rights do I have in regaining custody of my child? They claimed that I abandoned him and am unfit, that of course is untrue, seeing as how they were well aware of my intentions and I also gave them legal gaurdianship before I left. If the court decides to terminate my rights, can I insist he be removed from their care and placed with a family member of blood relation, even if they live in another state?
