If you have filed for divorce, you cannot, as once a divorce case is filed in Colorado, an automatic temporary injunction goes into effect and you have to get the other spouse's consent or a court order to take the child out of state. If nothing has been filed, you can take the child out of state, but it would be best to let the father know where you are going, how to reach you, etc. (I am assuming you are talking about a vacation or the like - not leaving without the intent to return).
