Legal Question in Family Law in Colorado
I pay child support for my three, almost four-year-old son. My son's mother uses daycare during her time with him and those costs are included in my support obligation. I just found out yesterday that my son's mother's daycare provider hasn't received payment from her for four months, now owing the daycare provider over $2,000. The daycare provider hasn't even received my portion of the payment (S), which means my money has gone elsewhere. A few days ago I received an updated financial affidavit because I was awarded an extra overnight with my son in May. Included with the financial affidavit was a letter stating the daycare provider provided child support registery with a notarized document stating my son's mother was paying $150 a week. Obviously this is not the case considering my son's mother has not paid daycare in four months. Is there anything I can do about this?

Being behind on daycare does not help you. Your ex is still responsible for paying for daycare. She will be sued by the daycare provider and ultimately have to pay. If the child is actually receiving daycare, the charges are not going to just go away. Unless you want to actually start paying the daycare provider directly and then seek modification of your child support order, there is nothing for you to do.
