Legal Question in Family Law in Colorado

Paystub for Divorce Filing

My wife and I went to file for divorce and the clerk said they needed a paystub from both of us. Why do they need this? We have agreed on who keeps what. She doesn't want alimony or any payout. We just don't get it. I have also been working about 20 hours of OT every week for the past 6 months and need to know if they will base some number on my gross earnings. Please help.

Re: Paystub for Divorce Filing

I gather you do not have any children? In that case, the paystubs will be used for only one thing. The Judge will look at them to compare to your agreement that you have worked out. The Judge has an obligation to make sure that agreements people reach are not unconscionable to either side. The only places your income would be used to determine "some number" is in relation to child support or maintenance (alimony). If there are no children, and she is waiving maintenance, then you should have nothing to worry about.
