Legal Question in Family Law in Colorado

Post Divorce

In 1985 I was divorced in Arapahoe County, CO and my former husband moved to UT. He has suddenly moved up his retirement date by over a year (thus unilaterally deciding to stop the alimony) and has significantly reduced the amount of money of his pension that he had previously stated. There was not a QDRO filed in 85.

1. How can I now obtain a QDRO?

2. If he stops the alimony (awarded until my death/remarriage) without a court order, what is my recourse?

Re: Post Divorce

I do not understand why the retirement automatically stops the alimony. Perhaps he's choosing to stop sending the payments because he's retiring?

I am not aware of anything that would let you go back and get a QDRO at this late date.

If he stops paying the alimony, you can take him back to the court the case was filed in and file a motion for citation for contempt of court. The court can then take action against him to get him paying again.
