Legal Question in Family Law in Colorado

Power of Attorney

My divorce was final a year ago. My ex-wife is the primary holder of a joint auto loan. I have made the payments to this loan ever since we bought the auto. I was awarded the auto in the decree. A power of attorney was to be filled, yet has not been done. I need to remove her name from the auto loan. What do I need to do? She was required to file the power attorney and never has.

Re: Power of Attorney

If you haven't already talked with your wife directly about filing the power of attorney, I have two suggestions. First, try refinancing the loan with a certified copy of the court order granting you the car and the loan associated with the car. If this is not enough, or you have already tried this, then you might need to file a motion to enforce the order against your wife. This will go through the court so that they are aware that she is not complying with their order.

Please feel free to contact The Harris Law Firm directly if you would like to discuss this matter in further detail. We would be happy to assist you.
