When you have previously used a lawyer. can someone filing against you use the same one?

Generally, no. It is an impermissable conflict of interest. There may be a very few narrow exceptions to this, but they are specific and few. You should consult an attorney in your area about the specific details of the situation. If you believe an attorney is engaging in such a conflict, you should report it to the Colorado Attorney Regulation Counsel for review.
