Reduction of Child Support

I was awarded a child support amount over a year ago, which included half of my childcare expenses to paid by the other parent. The other parent of course thinks that this amount is too high and has threatned from day one to take me back to court to get the amount reduced. He now claims that he will be leaving his current job to start a new job and thus is asking to reduce the amount of child support that he is currently paying. My question is what are his rights as well as the right of me and child. Can he change jobs to recieve a lower income and therefore be required to pay less in child support?

If you can establish that he quit his job instead of being laid off or otherwise terminated, the court may not reduce his child support given those dynamics.

You statement of facts is consistent him telling you this just to harrass you. This type of harrassment often stops if it doesnot get a positive response.

Another option would be for you to contact the family support department in you county and open a case file. That office will then enforce the support order and respond to any attempt to reduce the amount of support. There is no charge to you for this service. The attorneys working there and the court commissioners that hear these cases are familar with this approach.
