Legal Question in Family Law in Colorado

Request for Revocation

How do I request the Court (Judge) to dismiss a petition for a disolution of a supposedly ''Common Law Marriage''? The fact is, I am married since 1974 never got a divorce (separated since 1981) and have been living with another woman ever since. We really don't have any community property except for a car.I purchased a house in my name. Now she moved out and has petitioned for a divorce, took all that she bought and more. The question is how do I phrase that request for revocation if at all it's viable.

Re: Request for Revocation

It wouldn't be called a revocation. It would be called a dismissal. Yes, the fact that you remained married to someone else throughout the relationship is a solid reason to tell the Court that it has to dismiss the case because there was no marriage.

You need to file a Motion for Dimissal with the Court, and explain what you have here.

If you want to do something about the things, you will need to file a civil suit.
