Legal Question in Family Law in Colorado

What happens if a respondant can not be located for service of papers

My Ex girlfriend has recently quit her job and moved out of her house. She lives in A town one hundred miles away and I have been unable to reach her in a few weeks. I am afraid I will lose all of my filing fees and money paid to get her served custody papers if she can not be located. I am strugling financialy and can not afford a lawyer. Any help would be appreciated

There is another option available for service. Aside from personal service, you might be able to serve the respondent by publication in the local newspapers approved by the court for the town(s) you think your ex-girlfriend might live in.

However, to serve by publication you must first have the court's approval. Usually, a court will approve this type of service if you show that you have diligently tried to personally serve the respondent, but have failed.

If you need more information, you should, if possible, use the Colorado Courts' website at www.courts.state.co.us. In the self-help center you might find a lot of helpful (and free) information.
