Step parental rights

My husband and I are married by common law in the state of Colorado. He has an escalating drug problem. I would like to kick him out of the house until he seeks help, but I want his kids (my stepkids) to stay with me. Do I have any legal rights in this situation?

Generally, step-parents have no legal rights regarding step-children that they have not formally adopted. However, perhaps your husband might be more open to getting help if you let him know that you'd be willing to take care of the kids in his absence.
