Stepparent Adoption

My husband would like to adopt my 6-year-old daughter from my previous marriage. I have contacted my ex and he stated that he will not consent. He only pays a partial amount of ordered support, and has had no contact of any sort with her for over two years. No gifts, letters, nothing. What are my options? She expresses her desire to be adopted, literally several times per week.

The stepparent adoption statute indicates a parent can be stripped of his or her parental rights for failure to pay child support (any) for a period of one year, or failure to have contact with the child for one year. Judges are more comfortable ruling where both conditions exist; however, it may be useful to ask the court to allow the adoption even where only one condition is met. My experience with the process is that the parent whose rights are being challenged usually capitulates before the process is complete and consents to the adoption--particularly where there are efforts to collect on unpaid child support.
