Taking parental rights away.

My daughter was born in 1999. Her biological father left us in 2001 to live with another woman. He disappeared, I never heard from him. In March 2005 he took me to court. He got every other Sat and had to pay child support. It was dismissed from court Aug 2005. I moved out of state Aug 2006. He has nothing to do with her and didn't when the court ordered him to. Can I have his parental rights taken so my husband can adopt her. He's been there for her since she was 2yrs. I asked her biological father to sign over his rights. He doesn't see her or pay child support. My daughter does not like him at all. What do I do? What are my options? I love my daughter, all she wants is to carry my husbands name and for her ''father'' to leave her alone.

Re: Taking parental rights away.

First, your current husband can adopt your daughter, under the law of the state in which you currently live, regardless of whether he is the biological father. Second, you can file a motion to modify parenting time and child support for the biological father, which will modify his parenting time. For both of these steps, you should contact an attorney to assist you.
