Tape recording regarding child welfare

Is tape recording a husband's verbally abusive treatment of his wife,(which consists of foul language, belitteling and vulgar name calling in front of the kids), admisable in cout by a judge in a divorce case if the husband is not awhere of the fact that he is being tape recorded? If it is, would

tape recording the same person be allowed if it were over the telephone? When is or isn't this activity allowed in court as evidence? Considering it's in the best interest of the children, I am hoping that it would be accepted as evidence in a divorce case.

In Colorado, it would most likely be admissible.
