Legal Question in Family Law in Colorado

trial separation

My wife wants to try a trial separation but wants me to leave. I am not comfortable with her emotional state and am planning on taking my children with me for a couple of weeks to ''give her some space''. Is there any repurcusions to me leaving for a couple of weeks? Will this affect anything in a divorce case if it comes to that?

Re: trial separation

From a purely legal perspective, based on the bare facts you have stated, it does not appear that there would be any reason for negative repercussions. However, as a practical matter, it can have an effect. It can set certain tones and may even create some slightly different initial presumptions. Even so, it is unlikely to cause any issues that cannot be overcome relatively simply.

Keep in mind that the longer you are gone before filing for divorce, the more likely it is that the Court can be persuaded to continue whatever arrangements you may make during that period for things like paying bills and taking care of the children.
