Legal Question in Family Law in Colorado
Will I be in trouble if I kept my daughter in NJ rather then CO, the mother disagrees but no courts have ever been involed? The mother is being evicted in CO and I have a place here in NJ for my child to live and go to school. She is with me now and I would like to keep her here, I have not filed for custody and I have checked with the state of CO and the mother has not filed neither. I have tried to talk with the mom but she is no negotiable and impossible to talk to. I have a job and a stable place for my child here. I wish to keep my child with me as the situation in CO is not a good one for my child to live in. The mother has a drinking problem and has drug users and other alcoholics living with her, I feel this is the main reason for the eviction. Please help.

If there are no court order, each parent has an equal right to the child and you can keep her. Check NJ law - at some point if you keep the child in NJ, NJ will have jurisdiction and you can file there (likely 6 months). You also could file for allocation of parental responsibility now in Colorado (assuming the child just recently went to NJ). Hope this helps.
