My x girlfriend took our son to Mexico when he was 1 he now is back in the U.S. after 7 years but with his uncle and aunt I want to take custody of my child. He has been living with his uncle for 8 months but I just found out he was back in the U.S. and mom is deported im a US citizen can I take him for her brother. Or do I still have any rights over my son. You can call the police and see if they will help you pick up your son. Perhaps with the birth certificate you can get their assistance.

You can expect that the aunt and uncle will file for custody orders soon thereafter if you are successful. You may want to think about whether abruptly taking the child from where he is into your home will be in his best interests. It might be best if you start by filing for custody orders from a court. It would be a good idea to work with an attorney.
