Legal Question in Civil Litigation in Colorado

attorney client confiedentiality

an attorney retained by an employer

represented individual and employer

in a non compete suit filed against

individual by former employer.

Employer paid out in settlement and

all parties sigend settlement and

release holding all harmelss in

anything arising in future from suit.

Now 3 yrs later individual has quit

employer and same attorney is suing

individual and trying to recover $$

paid at settllement by employer.

Since individual disclosed personal

info to attorney when represented by

attorney, and now same attorney is

suing individual about similiar

circumstance doesn't that violate

attorney client confidentiality/ethics?

If I understand you correctly -- that the same attorney represented both plaintiff and respondent in a lawsuit -- it's almost impossible to believe so stupid and unethical an arrangement occurred.

So yeah, I'd say there's a problem there.
