Legal Question in Civil Litigation in Colorado

My brother bought a car for his girlfriend but the title is only under his name but she does pay him monthly for the payments the just recently broke up and he wants the car back, do they have to go to court or does he have a right to take it back without any legal action?

It sounds like if he takes the car back he will have breached his agreement with her.
