Legal Question in Civil Litigation in Colorado

Liability protection for volunteer first aid team workers

Members of our landowners association have formed a First Response team for the sole benefit of association members. If we receive funding from the association for supplies and training, could the association be liable in the event of a lawsuit?

Re: Liability protection for volunteer first aid team workers

This is a difficult question to anwer, but as with many such questions the proper answer is "it depends."

One would suppose that if there were a lawsuit from someone who was injured by the team and the allegation was "inadequate training" then the association, who funded that training, would logically be named as a defendant.

On the other hand, if the allegation was negligent operation of a motor vehicle, it is difficult to see how the association could be held responsible for that.

Typically in the event of a lawsuit everybody associated with the organization gets sued, but some later get dismissed when it develops they had no rational connection to the wrongful act.
