Legal Question in Civil Litigation in Colorado
Replevin
My aunt passed away and her husband is not in jail. I am taking him to court for my grandfather and my aunts ashes. How do I prove to the judge that I am the rightful owner of their ashes. I want to fulfill their last wishes and put their ashes in the ocean. Please help!!

Re: Replevin
Unless your aunt left you her ashes in her will, you are not the rightful owner of her ashes; her husband is.
If she made provision in her will that her ashes should be scattered at sea, and her husband is impeding that, you may file a probate action to enforce the will.
Good luck. I hope your aunt finds the peace she seeks, if not the peace you seek.
