Legal Question in Civil Litigation in Colorado

Trees overhanging branches

There is a tree in my backyard that has limbs overhanging the wall separating my back yard from my neighbors back yard. He wants the tree cut down and claims it is encroaching on his property. I don't want to remove the tree. Does my neighbor have any legal recourse? He is threatening a law suite and liens against my property for ??

Re: Trees overhanging branches

Your neighbor likely may cut any overhanging branches, to the property line. He may not remove anything on your side of the line, nor may he successfully sue to have you do it.

Tell the jerk he is lucky to have the shade from the tree, as it cuts his exposure to skin-cancer-causing rays of the sun whenever he's lurking near the wall. Sounds like he lurks a lot there, to be bothered by the tree.

Good luck.
