Filing an I-751 Late

My husband and I were married in Feb of 2005, we filed and he has a green card currently. We both believed the status expired in August 2008, however when we pulled the card out to look because we were getting the I-751 ready, we noticed that it expired in March 2008. I am afraid because when I called USCIS they told me that he is subject to court deportation preceedings. I have not submitted the I-751 and USCIS never asked me on the phone for his A#. Can I just file it now, late or do I need to do something else? Also it is unclear to me in the directions if he needs fingerprinted & photos again or if that is just for people living overseas? Please help me as we have two children and my family would be devistated if he were returned to his country.

Re: Filing an I-751 Late

You should immediately file I-751 with a cover letter explaining why it is being filed late - you thought it was a different expiration date. Also, fingerprints go stale within 15 months - for immigration purposes - and must be retaken.
