Legal Question in Immigration Law in Colorado

Length of time for Fiance' Visa

My fiance is going to move over from England as soon as possible. We have met several times with me going to England and her visiting Denver. We are investigating how should this be approached. We discussed getting married while she is visiting, but worry about defrauding the government. The fiance Visa (I-195) would work, but we worry about the length of time for processing. She is filling her Biographical information (G-325) out currently and I will mail that to INS when it is returned to me. How long should this whole process take?

Re: Length of time for Fiance' Visa

It's unclear from your question if you're asking about the K-1 Fiancee Visa, but I assume you mean that visa. It's also unclear why you refer to a form I-195 because that is not the correct form number to petition for a K-1. You use Form I-129F to petition for a fiancee.

Since you're in Colorado, you would submit your petition to the INS in Lincoln, Nebraska. I don't have the current estimate of the time it takes for Nebraska to finish a K-1 case, but the California Service Center and the Vermont Service Center take about 15 to 30 days to process, with the Texas Service Center taking a little longer, at about 45 days. So Nebraska should be about a month or so.

After the INS approved the fiancee petition, the file is sent over to the US Consulate in London since she's in England. They'll send her the immigrant visa application package with instructions. She'll be interviewed at the consulate. I'm not familiar with how long it will take for London to do all this. Maybe a month to 2 months at most.
