Legal Question in Immigration Law in Colorado
getting married
Hello,
I am getting married to a non - USC, and her J1 Visa has expired on 10/1/04. We met while working in the same building and I did not know her before she came to the US. We are planning to be wed at the end of Oct. Can she stay in the US while we file the nessary documents. What are the documents needed to be filed. I've tried looking at the imagrations web page however was unable to find this information. Any asstance you can provide is greatly appreicated.

Much would depend on whether she is subject to the two-year foreign residency requirement. Otherwise, the marriage would cure any unlawful employment and the overstay.
