Rententering into u.s.a

I got the approval on august 31, 2006.

I am planning to go to India around november 2006 and come back

during january 15th 2007 ( but my visa is stamped in my passport until 27th jan 2007)

Will immigration people allow me to enter into u.s.a because by that time

I will have visa for just another 12 days in my passport. (is there any rule that when we are entering into u.s there should be atleast a visa valid for another 6 more months).

while coming can I show visa which is valid until jan 27th and the approved

I-797

please help me I have to make decision faster

Well, your question is not very clear and specific.

What do you mean by I hava a visa: What Visa? I am just assuming you have an H-1B valid visa lasting until feb 07. If you have a valid visa and you are also maintaining a vaild nonimmigrant h-1b status in the US, you may reenter into the US even a week/day piror to the expiration of your visa stamped in your passport. You must also carry a valid passport and I-797 H-1B approval. No problem if you have the foregoing situation and items mentioned above. Good luck and have a safe trip.
