Legal Question in Immigration Law in Colorado

What will happen if my husband who is an Illegal Immigrant that has been in the USA illegally for 10 1/2 years turns himself into immigration. What would his chances be that he wont be deported? Could he qualify for cancelation of deportation? we are marred and have a 5 year old daughter , and I am a us citizen. The reason he wants to do this is he is tired of living here illegally. He can't work because he is here illegally, and he just wants to make a better life for us and our daughter., He has no criminal record he was only arrrested twice for driving without a license. The only thing that he did wrong was give them a fake name becasue he was scared and did not know what would happen. Other than that he has been free from any other incidents.

He will certainly face deportation if ICE (Immigration/Customs Enforcement) becomes aware of him. However, you (or maybe if he has US citizen parents or adult children) could petition for him to receive his greencard and well as a work permit in a few short months. If your husband entered the United States without inspection, he will not be eligible for adjustment of status even if you are a US citizen and sponsor him, but he will qualify for cancellation of removal if he has been here at least 10 years. That relief must be applied for with an immigration judge and there are a few ways to get before a judge, but the burden of proof is very high and your husband should definitely have legal representation.
