auto accident
I was in an auto accident and the insurance company is refusing to pay lost wages in a settlement. Can I take the settlement offer from the insurance company and sue the individual responsible for the accident for my lost wages?

Any claim you have against the other driver is not limited by the insurance that he carried. Thus, you could pursue lost wages even if the driver's insurance would not cover the judgment. The carrier will probably want a full release, however, if it pays anything. Unless the carrier will agree to exclude claims for lost wages from the property damage/personal injury settlement, you probably could NOT recover from the individual after accepting the carrier's offer.
