Legal Question in Insurance Law in Colorado

Insurance liability

If a vehicle is owned by one person, can anothe member of the family insure that vehicle?

I have a vehicle titled in my name, age 53, in the State of Colorado. My son, age 27, in Colorado also, drives that vehicle. I want him take ownership, but he has neglected to transfer the title into his name. He claims, he has called his insurance carrier and insured the vehicle. Is that possible? Is it legal?

The vehicle is paid for, there are no loans.

Re: Insurance liability

The insurance questions I concentrate on involve the Federal law ERISA and disability benefits.

I am not licensed in Colorado state courts so I AM NOT GIVING LEGAL ADVICE-more like common sense suggestions.

Call up your insurance agent and ask him/her the same questions. I am in Texas and we have to have a piece of paper in our car called a proof of insurance. You must know whether you have to carry such proof. If you do ask your son for a copy. If he does not give you a copy ask your agent what it will cost for you to insure the vehicle (at least for liability). Also how is your son's driving record. In Texas we have something called negligent entrustment (if you are the owner of a vehicle and you are dumb enough to let somoene with a history of DWI drive your car and he gets drunk, drives the car and kills someone you are liable under the pretty dumb rule).

can you transfer the title to him yourself? In Texas the state collects sales tax on a sale. I imagine Colorado does also. Maybe your son is supposed to pay it (as the two of you agreed) but depending on the amount of the sales tax and the sleep you are losing over the insurance question paying the sales tax and the cost of transfer may be a pretty cheap sleeping pill.
