Copyright Law

Is an artist infringing upon copyright laws when creating

illustrations from uncopyrighted photographs dating from the

1800's (historical photos)? These photographs are currently

housed at a local history museum.

Photos from the 1800's are to a near certainty in the public domain - if they were published with no copyright notice, they were dedicated to the public domain anyway, but by now the copyright would have expired. So you are free to copy them in illustrations, or however.
