Legal Question in Intellectual Property in Colorado

Internet advertisement of business idea for sale

I have developed a business idea, in practice, that I would like to market and sell through the internet. I am curious of what I need to be aware when selling my idea. I have applied for my tradename in Colorado; will I need to apply for the tradename nationally? I did already complete a search to make certain my name was not already in use.

The business can be performed virtually in any location with many different possibilities to offer clients. Will I need to provide legal documents that are state-specific to each individual who purchases my idea (i.e. Independent Contractor agreements or other employment contracts)?

Are there any special licenses I need to secure? How do - and can - I protect my interests in the name and services provided?

Re: Internet advertisement of business idea for sale

A trademark protects only a name or logo, and does not protect the underlying invention. If you have registered for the name in Colorado only, then the name only is protected in Colordao, and not outside of the state. If you want to protect the business method itself, it is possible to apply for a patent through the US government (this cannot be done through the states). Please contact me if you are interested in filing a patent application, or have additional questions.
