Legal Question in Intellectual Property in Colorado

Non Citizen Question

My wife is a permanent resident and is home sick. She wants to go home to the philippines and does not know if she will be back. What steps should I take to handle our finances here in Denver, Colorado? We have two cars and a house together that she has her name on. What legal advice would you give me to take care of if she does not return back to the United States because it was to hard on her to live here because of the difference in cultures?

While I take no issue with Dave Anderson's answer you also want to insist that your wife be represented by separate counsel to avoid any future claim that she was coerced or fraudulently induced into signing away her rights.

You did not state whether you have children so I will assume none. BIG ISSUES if you do.

Re: Finances- you should at a MINIMUM have her sign over to you a DURABLE POWER OF ATTORNEY document.

In addition, have her sign over titles to cars and deed to house would also be advisable. If you also have a Mortgage, be aware that unless you plan to pay it off before she leaves, you both are still on it. In most cases, you would have difficulty selling without her signature ( unless you have the POA in place.)
