Legal Question in Intellectual Property in Colorado

My sister gave me $ 5000 last year and is now taking me to court to make me pay it back. We never had a written agreement and at the time she actually said I don't need to pay it back.

Today I've been served with court documents - do I have to go to court? Does she even have a case against me for not paying her back?

You must answer the complaint in the time required or you risk a default judgment. You also need to assert all affirmative defenses such as your claim that this was a gift.

Anyone can sue and claim whatever they want. It will be left up the judge or jury to decide who they believe. You need to contact an attorney to advise you on how to answer the complaint and protect your rights. As a practical matter, the amount at issue is too small to pay an attorney for a full representation. You may, however, retain an attorney on a limited representation and they can then advise you on procedure and strategy.
